Terms of Service — Graham Digital Solutions

These Terms govern your use of grahamdigital.co and the services of Graham Digital Solutions LLC ("GDS"), including the Voltiq CRM platform ("Voltiq"). By using our site or services you agree to these Terms.

1. Services

GDS provides digital operations consulting and, for subscribed clients, access to Voltiq — a white-labeled CRM platform including pipelines, unified inbox, SMS/email tools, calendars, automations, and reporting. Specific deliverables, timelines, and fees for builds and retainers are defined in each client's proposal or order.

2. Subscriptions & payment

Voltiq CRM access is billed monthly in advance (from $497/mo) via Stripe. One-time build fees are due per the applicable proposal.
Monthly subscriptions are month-to-month and may be canceled with notice before the next billing date; cancellation stops future charges but fees already paid (including usage credits for SMS/email/AI) are non-refundable.
Usage-based charges (SMS segments, voice minutes, AI messages, email volume) are passed through as consumed.

3. Client data

You own your data. Contacts, conversations, and records you store in your Voltiq account belong to you, and you may export your contact data upon termination. You are responsible for having the necessary rights and consents (including SMS opt-in consent from your contacts) for the data and campaigns you run.

4. GDS intellectual property

GDS retains ownership of its know-how, workflow designs, templates, snapshots, and platform configurations. Clients receive a license to use them within their Voltiq account for the duration of their subscription.

5. Messaging compliance

Clients must comply with applicable messaging laws and carrier rules (TCPA, CAN-SPAM, A2P 10DLC), including honoring STOP/HELP keywords. GDS may suspend messaging that violates carrier policies.

6. Disclaimers & liability

Services are provided "as is." GDS does not guarantee specific business results (lead volume, conversion rates, or revenue). To the maximum extent permitted by law, GDS's total liability for any claim is limited to the fees paid by the client in the three (3) months preceding the claim; GDS is not liable for indirect or consequential damages, or for outages of third-party platforms and carriers.

7. Governing law & disputes

These Terms are governed by the laws of the State of Florida. Any dispute will be resolved by binding arbitration in Pinellas County, Florida, except either party may seek injunctive relief in court for IP misuse.

8. Changes

We may update these Terms; continued use after an update constitutes acceptance. Material changes for active clients will be communicated by email.
